Breach of Agreement

Prohibited uses include, without limitation: operation by an unauthorized driver; operation by a person whose license is suspended or invalid; driving under the influence of alcohol, prescription or non-prescription drugs where prohibited; obtaining or extending a rental through false, fraudulent or misleading information; use for an illegal purpose; unauthorized racing, speed testing, towing, pushing or transporting hazardous or illegal materials; use outside any agreed geographic limitations; loading beyond the Vehicle's capacity; operation on unpaved roads where not authorized; carrying more passengers than available seat belts; tampering with the odometer or vehicle systems; operating the Vehicle when warning indicators or low fluid levels make continued operation unsafe; reckless or willful misconduct; or failure to contact local police when required after an accident involving injury or property damage.

Charges

You will pay us, or the appropriate government authorities, all charges due under this Agreement, including, where applicable: time and mileage charges; additional-driver charges; optional products and services; fuel charges; applicable state and local taxes; parking, traffic and toll violations; fines, penalties, forfeitures, court costs, towing, impound and storage charges; costs associated with a Vehicle that is lost, stolen, damaged, returned late, repossessed or abandoned; reasonable costs we incur locating and recovering a Vehicle; collection costs and attorney fees where permitted by law; late-payment fees where permitted; returned-payment fees; and reasonable cleaning charges when the Vehicle is returned substantially less clean than when rented.

Deposit

We may use your security deposit to pay amounts owed to us under this Agreement, including damage, unpaid tolls, tickets, fees, cleaning, missing fuel, or other authorized charges accrued during your rental period. Any refundable balance is handled according to our Refund Policy and applicable agreement.

Used Vehicle Sales & Purchase Process

  • As-Is Condition. Unless otherwise stated in a signed purchase agreement or required by law, used vehicles are sold “as-is” without any express or implied warranty of merchantability or fitness for a particular purpose.
  • Buyer Inspection. The buyer is responsible for inspecting the vehicle to their full satisfaction prior to purchase. Aspire Rental encourages an independent pre-purchase inspection. By completing the purchase, the buyer accepts the vehicle in its then-current condition.
  • Odometer Disclosure. Any odometer disclosure required by federal or state law will be provided at the time of sale. Aspire Rental will disclose the mileage shown on the odometer and known discrepancies as required.
  • Deposit / Payment. Deposits and payments made toward a vehicle purchase are applied to the final sale price. If the buyer cancels after a deposit or payment has been made, amounts may be non-refundable as described in the Refund Policy and applicable purchase agreement.
  • Title Transfer. Title-transfer timing, registration, taxes, fees, and documentation are handled according to the purchase agreement and applicable federal, state, and local requirements.
  • Final Sale. Once the purchase is completed and required transfer documents are executed, the sale is final except where a written agreement or applicable law provides otherwise. If Aspire Rental fails to deliver the purchased vehicle as agreed, payments will be handled according to the applicable agreement and Refund Policy.
  • Wear & Imperfections. The buyer acknowledges that used vehicles may exhibit normal wear, cosmetic imperfections, and mechanical conditions consistent with the vehicle’s age and mileage, and these do not by themselves constitute a breach of the sale agreement.

Miscellaneous

A waiver by us of one breach is not a waiver of any later breach or of your other obligations. Our acceptance of payment, or our delay or failure to exercise a right, does not waive other rights under this Agreement. If any provision is found invalid or unenforceable, the remaining provisions remain in effect to the extent permitted by law. Any limitation or release of liability applies only to the extent permitted by applicable law.
